Cui Yingjie's case is about to be decided
On December 12, 2006, the murder case of Li Zhiqiang, an urban management cadre in Haidian District of Beijing, was held in the first instance of Beijing No.1 Intermediate People's court. Unlike Li Zhiqiang, whose image is widely known, this is the first public appearance of street vendor Cui Yingjie. Cui Yingjie, a 23-year-old defendant, was charged with killing Li Zhiqiang, the vice captain of the group, when urban management officers confiscated his tricycle. Standing with him in court at the same time were four friends who were charged with harboring and helped him in his escape. the prosecution changed the crime of intentional injury in the public security prosecution opinion to the crime of intentional homicide, which means that if the court finds the charge appropriate, death penalty will become Cui Yingjie's preferred sentencing. the defense opposes the accusation. Two lawyers who provided legal aid for Cui Yingjie believe that Cui Yingjie's behavior was only intentional injury causing death. If the court accepts the defense's opinion, it implies that Cui Yingjie will save his life. For Cui Yingjie, the most direct difference between intentional injury and intentional killing is life and death.
Scholars of criminal law: it is not appropriate to apply death penalty
in the first instance, the prosecution broadcast the video of the scene of the incident in court, which is considered to be the most critical evidence in the Cui case. "It never occurred to me that the camera in my hand was not turned off, and the accidental pictures let people see the process of Li Zhiqiang's killing." In an interview with the Legal Evening News in Beijing, Wang Jinbo said that Wang is a staff member of the publicity section of Haidian urban management brigade. In order to preserve his work materials, he participated in the joint operation. the picture shows more than a dozen law enforcement officers around Cui Yingjie. Cui Yingjie holds a knife in his hand and instinctively dances, but his tone is weak: leave the car for me and take the rest. The voice of Chengguan said, put down the knife, put down the knife. The final scene of the dispute is Cui Yingjie kneeling on one knee, his left hand still clinging to the tricycle. "I begged them to take anything away, that is, please leave my tricycle, because I just borrowed money to buy it the day before yesterday." Cui Yingjie described the mood at that time in the trial. the Chengguan finally took over and began to withdraw. The picture shows their scattered back. Cui Yingjie, who has left the scene, suddenly leaps into the camera from behind. The crowd is in chaos, then blood, and then Cui Yingjie turns around and runs to the blue figure deep in the alley. "It was very painful at that time, the moment when I saw the tricycle loaded on the truck." Cui Yingjie said, "I saw that someone who sold Hami melon in Xinjiang could ask for a return at the last moment, so I rushed up again. When I passed Li Zhiqiang, I touched his hand and thought he was going to catch me, so I picked it up. I didn't know where it was at that time. " For this fatal action, Cui Yingjie made the above explanation. Cui Yingjie also said that he had given up the fight, but when he saw that the girl who helped him was still arguing with the "Gang", he went to ask for a car. the indictment shows that when Cui Yingjie was investigated and dealt with by Haidian District urban management team for operating without a license, he threatened and hindered the normal law enforcement activities of urban management personnel with a knife, and stabbed Li Zhiqiang (male, 36 years old), vice leader of Haidian urban management team, in the neck, injuring Li's right cephalo brachial vein and right upper lobe of lung, resulting in Li's death from acute hemorrhagic shock. the prosecution accused Cui Yingjie of using violence to obstruct the urban management and law enforcement officers from performing their official duties, and killing people with a knife. The circumstances are bad, the circumstances and consequences are particularly serious, and the social harm is great The criminal responsibility shall be investigated for the crime of intentional homicide. " Defense lawyers Xia Lin and Li Jinsong think that Cui Yingjie's intentional homicide is not tenable. They said that there are two characteristics of criminal intent: one is that the perpetrator knows that his behavior will harm the society; the other is that the perpetrator holds a hopeful or laissez faire attitude towards the harmful results. Cui Yingjie and the victim Li Zhiqiang have never known each other. Cui's behavior is to save his tricycle and worry that he may be forced to get away. When he is eager to get away, he will wave a knife casually. after Cui Yingjie fled to Tianjin, he sent a text message to his friend asking about Li Zhiqiang's injury. The lawyer said that this can prove that Cui Yingjie did not foresee the consequences of Li Zhiqiang's death and had no subjective hope or laissez faire attitude towards the result of Li's death.
