Zhou Yuheng is a graduate student of Xiangtan University. Zhou Yuheng was killed on campus in 2003. The suspect was identified as Zeng Aiyun and Chen Huazhang, because Zeng Aiyun and Zhou Yuheng fell in love with a girl at the same time, while Chen Huazhang was dissatisfied with the teacher's respect for Zhou Yuheng. Zeng Aiyun and Chen Huazhang are classmates of Xiangtan University, and they have a good relationship. After graduating from the University in 2001, Chen Huazhang continued to study as a graduate student, while Zeng Aiyun took part in the work. In 2003, Zeng Aiyun passed the postgraduate entrance examination and studied in the school of mechanical engineering of Xiangtan University in September of the same year. Before long, Zeng Aiyun began to associate with Li Xia, a female graduate student of the same profession at the same level, and eventually developed into a love affair. previously, Li Xia and Zhou Yuheng, a 2002 graduate student in the school of mechanical engineering of Xiangtan University, had been in love for many years. According to the prosecution, Zeng Aiyun was annoyed and talked with Chen Huazhang about the relationship with Li Xia and Zhou Yuheng for many times, and proposed to Chen Huazhang to teach Zhou Yuheng a lesson. The prosecution said that Chen Huazhang was also jealous of Zhou Yuheng. From October 24 to 27, 2003, Chen Huazhang bought 36 diazepam tablets in Xiangtan University Hospital and Xiangtan central hospital three times. At about 6:30 p.m. on October 27, Chen Huazhang came to Room 308, South Building of Xiangtan University half an hour earlier than usual. In Zhou Yuheng's absence, he ground 16 diazepam tablets into powder, mixed water and filtered them into Zhou Yuheng's tea cup. according to the indictment, at about 10:28 p.m. on October 27, 2003, while Li Xia was answering the phone, Zeng Aiyun got up and ran to the South Building of engineering. After arriving at Room 308, Zeng Aiyun took out a brown rope and strangled Zhou Yuheng's neck from the right back. He collapsed Zhou Yuheng to the ground and continued to use force, causing Zhou Yuheng to suffocate and die.

Twelve years of litigation

In August 2005, the Hunan Provincial High Court made a ruling that some facts of Zeng Aiyun and Chen Huazhang's intentional homicide in the first instance judgment were unclear and needed further investigation. In December 2005, Xiangtan intermediate people's court made the first retrial judgment, and the result was the same as that of the first trial. In May 2008, the provincial high court made a final ruling, maintaining the original death sentence against Zeng Aiyun. On September 25 of the same year, the Supreme Court ruled that the defendant Zeng Aiyun's death sentence for intentional homicide was not approved, and the Hunan Provincial High Court's ruling that the defendant Zeng Aiyun was sentenced to death for intentional homicide was revoked. The case was remanded for retrial. In June 2010, Xiangtan intermediate people's Court issued a second retrial judgment, in which Zeng Aiyun was sentenced to death and Chen Huazhang was sentenced to life imprisonment. Case review

On the evening of October 27, 2003, Zhou Yuheng, a 2002 master's degree student from the school of mechanical engineering of Xiangtan University, was killed in Room 308 of the South Engineering building of Xiangtan University, and his body was thrown on the steps leading to the West nursery at the South Gate of the engineering building of Xiangtan University. After investigation by Xiangtan Public Security Bureau, Zeng Aiyun and Chen Huazhang were suspected of killing Zhou Yuheng. On October 29, 2003, Zeng Aiyun and Chen Huazhang were detained by Xiangtan Public Security Bureau on suspicion of intentional homicide and arrested on November 11, 2003. In June 2004, Xiangtan people's Procuratorate filed a public prosecution against Zeng Aiyun and Chen Huazhang for intentional homicide in Xiangtan intermediate people's court. Xiangtan intermediate people's court sentenced Zeng Aiyun to death and Chen Huazhang to life imprisonment in September 2004, December 2005 and June 2010 respectively, which was remanded to the Supreme People's court and Hunan Higher People's court for retrial. Xiangtan intermediate people's court formed a new collegial panel in accordance with the law. On April 17, 2013, the case was tried in public again. According to the suggestion of Xiangtan people's Procuratorate, it decided to postpone the trial twice. During this period, Xiangtan people's Procuratorate conducted supplementary investigation on the case, and Xiangtan intermediate people's court investigated and verified the evidence. The retrial of Xiangtan intermediate people's court found that the defendants Zeng Aiyun, Chen Huazhang and the victim Zhou Yuheng were all Postgraduates of the school of mechanical engineering of Xiangtan University. Because Zhou Yuheng was valued by his tutor, Chen Huazhang was jealous of Zhou Yuheng. In October 2003, Zeng Aiyun fell in love with his classmate Li, who had been in love with Zhou Yuheng for many years. From October 22 to 27, 2003, Chen Huazhang repeatedly went to Xiangtan Central Hospital, Xiangtan University Hospital and Xiangtan Municipal Hospital to buy a large number of diazepam tablets. On the evening of October 27, Chen Huazhang came to Room 308, South Building of Xiangtan University, where he studied with Zhou Yuheng. He smashed, dissolved and filtered the diazepam tablets prepared in advance and put them into Zhou Yuheng's tea cup. Zhou Yuheng had a drug reaction after drinking in Room 308. At about 19:28 p.m., Zeng Aiyun asked Zhou Yuheng to meet him in front of Xiangtan University Library by telephone. At about 19:50, Zhou Yuheng, who was dizzy and weak after taking the medicine, met Zeng Aiyun and Li with the help of Chen Huazhang. Later, Chen Huazhang helped Zhou Yuheng back to the dormitory on the ground that Zhou Yuheng was not feeling well. At about 21:00, Chen Huazhang took Zhou Yuheng to Room 308 for the reason of listening to songs in Room 308. Since then, Zhou Yuheng was killed in the room. Chen Huazhang simply cleaned up the scene with a green rag, hid the rag in a closet on the south wall of the room, and hid Zhou Yuheng's mobile phone in the drawer of the computer desk. At about 23:30, Chen Huazhang used Zhou Yuheng's mobile phone card to send SMS to Zeng Aiyun, Li and Zhou Yuheng's roommate. After that, he discarded Zhou Yuheng's mobile phone card and the rest of the diazepam. At about 23:40, Zhou Yuheng's body was found. Xiangtan intermediate people's court held that: in the evidence that the public prosecution accused Zeng Aiyun of killing the victim Zhou Yuheng, Zeng Aiyun's guilty confession, Chen Huazhang's testimony of Zeng Aiyun's murder, and witness Li's evidence about whether Zeng Aiyun had committed the crime were all questionable and could not be accepted. In the facts charged by the public prosecution organ, there is no definite and sufficient evidence to prove Zeng Aiyun's motive, whether he conspired with Chen Huazhang, the source and whereabouts of the tools of the crime, and whether he committed the crime or not. Therefore, the fact that the public prosecution accused Zeng Aiyun of intentional homicide is unclear and the evidence is insufficient, so the accused crime can not be established. based on the evidence of the whole case, it can be determined that the defendant Chen Huazhang had a long-standing grudge against the victim Zhou Yuheng and had a motive to commit the crime. Before committing the crime, Chen Huazhang bought a large number of diazepam tablets many times and drugged Zhou Yuheng. After drugging, he followed Zhou Yuheng closely. After Zhou Yuheng had returned to his bedroom, he took Zhou Yuheng to Room 308, South Building of engineering, on the ground of going to the engineering building to listen to songs. Since then, he has been with Zhou Yuheng until Zhou Yuheng was killed. After that, Chen Huazhang also carried out such acts as hiding criminal evidence, cleaning up the scene, and sending short messages to cover up the truth. The facts are clear, and the evidence is reliable and sufficient. Accordingly, Xiangtan intermediate people's court made the above judgment according to law. the family members of the parties, as well as some deputies to the National People's Congress, members of the Chinese people's Political Consultative Conference, media reporters and the masses attended the court to hear the verdict.
