Wu Shan, male, is the son of Bing Xin's eldest son Wu Ping and his ex-wife Chen Lingxia. On May 31, 2012, Wu Shan entered the memorial park without informing the plaintiff, and painted eight big words with red paint on the monument of Bingxin and Wu Wenzao: "no way to teach a son, no way to be a man". Later, he was sued by the cemetery management. On December 3, 2012, the first instance of the people's Court of Yanqing County in Beijing held a trial. The plaintiff and the defendant expressed their willingness to mediate on the restoration plan and budget.
Event introduction
On May 31, 2012, Wu Shan, the grandson of Bing Xin and Wu Wenzao, entered the memorial park without informing the plaintiff, and painted eight big words with red paint on the monument of Bing Xin and Wu Wenzao: "no way to teach children, no way to be a person".
Cause of the incident
Her mother, Chen Lingxia, was very angry when she heard the news. She said that she had participated in the design, construction and completion of the Bingxin couple's statue. Wu Shan's behavior is indeed a helpless move. She has been fighting a divorce lawsuit with her husband for several years. Wu Shan thinks that the court's judgment is unfair and there is no reason for her to do so.
Chen Lingxia said that she is a very traditional woman. Her husband divorced her because of an affair. She was embarrassed to let others know, because she was angry and went to the hospital several times. Secondly, she kept silent for so many years because she wanted to protect Bing Xin's reputation. Her son couldn't see it. In order to get justice for herself, she wanted to attract people's attention in this way.
Encounter a claim
The cemetery management believes that because the monuments of Bingxin and Wu Wenzao are cultural relics and valuable, Wu Shan's behavior has damaged his property. On October 19, 2012, in order to remove the red paint on the tombstone, the plaintiff hired a Beijing Mechanical Equipment Co., Ltd. to repair the red paint on the tombstone, with a total budget cost of 90000 yuan. The plaintiff sued Wu Shan for damages of 90000 yuan and made a public apology. Yanqing court is tentatively scheduled to hear the case on November 19.
Wu Shan's response
Chen Lingxia, Wu Shan's mother, said that for the compensation of 90000 yuan, Wu Shan had no job, no money to compensate and did not accept the claim.
Hearing
On the morning of December 3, 2012, the first instance of the people's Court of Yanqing County in Beijing was held. Bingxin's direct grandson Wu Shan did not appear in court. After the trial, the plaintiff and the defendant expressed their willingness to mediate on the restoration plan and budget. The time of the second hearing or sentence will be notified by the court.
Lawyer of the defendant: the budget of 90000 yuan is unscientific and unreasonable
During the trial on that day, the defendant Wu Shan himself did not appear in court. The plaintiff claimed that the defendant should compensate for the loss of 90000 yuan and make an apology. The reason is that Bingxin tombstone is a cultural relic and valuable, and the defendant's behavior has damaged the plaintiff's property. In order to remove the red paint from the tombstone, the plaintiff hired a Beijing Mechanical Equipment Co., Ltd. to carry out the repair budget, with a total budget cost of 90000 yuan.
Liu Gong, Wu Shan's lawyer, has no objection to the facts in the plaintiff's indictment. However, he said that the plaintiff has always claimed that the tombstone belongs to cultural relics, but has not submitted evidence, and should produce documents identified by the cultural relics administrative department.
Liu Gong also raised an objection to whether the company hired by the plaintiff to conduct the budget has professional qualifications. He believes that the company is a trading company with less than five employees. Even if it has a business license, it does not mean that it has the relevant industry qualification for stone cleaning and cultural relic restoration. The budget of 90000 yuan cleaning plan proposed by the plaintiff is also lack of scientificity, rationality and necessary basis. The 90000 yuan cost did not actually occur, it was just a budget, and the court should reject it. The evidence submitted by the plaintiff can not prove the extent of damage to the tombstone, such as whether the paint penetrated into the tombstone.
"I love my grandparents"
The defendant's lawyer also read a letter of apology from Wu Shan on the same day. Wu Shan said in the letter that his behavior has hurt the readers' deep feelings for Bing Xin. He once again sincerely apologized to the public for his reckless behavior, and also sincerely apologized to the spirits of his grandparents, "I love them.".
Wu Shan said that half a year ago, he made a "move against heaven" for his mother. She had a divorce lawsuit for six years, but for Bing Xin's honor, she didn't talk about it to anyone. Wu Shan said that he was willing to accept the result of the legal judgment and only hoped that his father would make compensation for his mother's friendship.
Liu Gong presented materials in court to prove that Chen Lingxia, the mother of the defendant, suffered from cancer, hypertension and other diseases. He said that Wu Shan's original intention was not to infringe on the tombstone, but to act irrationally for his seriously ill mother.
In this regard, the plaintiff held that even though Wu Shan did not want to infringe on the tombstone, he, as a person with full capacity, actually resulted in the infringement.
