A family in Sichuan has eight children, and the social support fee is reduced from 2.66 million to 90000

A family in Anyue County, Sichuan Province was charged 2.66 million yuan of social support fee for having eight children, which has aroused heated discussion.

On July 5, 2021, the interface news learned from the Health Bureau of Anyue County that the bureau decided to levy a total of 90000 yuan of social support fees on the family with an extra child. The decision has been approved and signed by the parties, and the two sides agreed to pay in installments.

Interface news previously reported that Liu's family in Anyue County gave birth to the sixth child in 2006, the seventh child in 2009 and the eighth child in 2010. On March 11, 2019, the Health Bureau of Anyue County, in accordance with the regulations of Sichuan Province on population and family planning revised in 2014, made a decision on the collection of social maintenance fees for the three children.

Liu's family will be charged 278400 yuan, 718080 yuan and 1666560 yuan for giving birth to the sixth, seventh and eighth child respectively. The total amount of the three "decisions on the collection of social maintenance fees" is as high as 2663040 yuan.

The person in charge of the policy and regulation unit of Anyue County Health Bureau explained that Liu and his wife gave birth to a total of eight children, all of which occurred before the implementation of the comprehensive two child policy. Therefore, according to the law at that time, except for the first child, social support fees should be levied on the fertility of the remaining seven children. Since the second and third children of Liu's husband and wife were born earlier, they have been charged with social support fees. Since then, the family planning office of Arched Bridge Township, where Liu is located, has damaged Liu's information in several floods, so it is impossible to determine whether the fertility behavior of the fourth and fifth children has been dealt with. Therefore, in November 2018, when Anyue County Health Bureau investigated Liu, it decided to collect social support fees only for his behavior of giving birth to the sixth, seventh and eighth children.

On May 8, 2020, Anyue County Health Bureau applied to the people's Court of Anyue County for compulsory execution of Liu and his wife. However, the court found that the materials were not perfect and returned them for supplement. On August 28, 2020, Anyue County Health Bureau applied to the court again for compulsory execution, and then the court formed a collegial panel to review.

The people's Court of Anyue County held that the administrative act of levying social maintenance fee by Anyue County Health Bureau in 2019 was based on the Sichuan Provincial Population and family planning regulations revised in 2014, but the Sichuan Provincial Population and family planning regulations had been revised and implemented for the sixth time in 2016. The court held that the family planning regulations on which Anyue County Health Bureau made the decision in 2019 had been abolished after the implementation of the newly revised regulations in 2016, so the three applications were not allowed to be implemented.

The policy and regulation unit of Anyue County Health Commission said that the new collection of social support fees was based on the latest revised Sichuan Population and family planning regulations, and solicited opinions from the court and lawyers. Combined with the actual situation of the parties, "it has dropped from the highest of 2.66 million yuan to about 90000 yuan now.". The person did not disclose the specific calculation standard, but admitted that the previous levy amount was on the high side.

After the implementation of the comprehensive two child policy, the local family planning regulations have been amended accordingly. For extra planned parenthood, the Sichuan Provincial Population and family planning regulations, which was revised and implemented in 2016, changed the collection standard of social support fee from "6-8 times of the base of the tax" to "3 times of the base of the tax" for each additional child.

On July 5, Liu told UI news that in April 2021, he received and signed a decision on the collection of social maintenance fees from the local health bureau. The other party told him that if he was unable to pay in one time, he could pay in installments. Later, both parties agreed to pay in three years. He said that he accepted the result of the punishment, but there are still five children in school, two of them have entered university and have a heavy burden.

"According to my actual income, I will pay as much as I have, excluding the expenses of my children and parents." Liu said, "I don't want to escape the fact that I can make as many as I can."
