Zeng Aiyun is a master of mechanical engineering of Xiangtan University. On the evening of October 27, 2003, Zhou Yuheng, a 2002 master's degree student in the school of mechanical engineering of Xiangtan University, was killed in Room 308 of the South Building of the Engineering Department of Xiangtan University. Xiangtan intermediate court sentenced Zeng Aiyun to death and Chen Huazhang to life imprisonment in September 2004, December 2005 and June 2010 respectively, which were remanded to the Supreme Court and Hunan Provincial High Court for retrial. on July 21, 2015, Xiangtan intermediate people's court declared the defendant Zeng Aiyun not guilty in the first instance of the intentional homicide case of Chen Huazhang and Zeng Aiyun. Zeng Aiyun has been waiting for more than 10 years for the acquittal. After the sentencing, he was sent back to his hometown Shaodong county, Hunan Province. Zeng Aiyun told China Youth Daily on the phone that he would not look back on his experience of being detained as a homicide suspect: "my mother was disabled and raised me through all kinds of hardships. I didn't expect that such a thing would make her suffer for more than 10 years.... " On the way to redress grievances, Zhong Zhiyuan, Zeng Aiyun's lawyer, is no longer in Shaohua. From a green silk to a decapitation, Zhong Zhiyuan has been involved in the judicial whirlpool for more than 10 years from free judicial aid to acting as a lawyer for Zeng Aiyun, who nearly died unjustly. In September 2003, after working for two years, Zeng Aiyun returned to his alma mater Xiangtan University to study as a graduate student in the school of mechanical engineering. On the evening of July 23, 2015, Zeng Aiyun told reporters that he had a miserable family background, lost his father when he was young, and his mother was disabled. He was able to complete his studies with the help of his three uncles and brothers. In his graduate school, he met his former classmate Chen Huazhang. This 25-year-old man, who soon dragged him into the abyss, was described by the media as a brother with "excellent feelings and money". But Zeng denied it. He said that Chen Huazhang was his classmate in the first two years of University, with excellent grades, and was also an important cadre of the student union. "At ordinary times, he looked like we were all on top of each other. Later, when he went to graduate school, he met us again. At a dinner party, Zeng Aiyun met Li Xia from the same college, and they had a good feeling for each other, and their relationship became closer. But before she met Zeng Aiyun, Li Xia and her graduate student Zhou Yuheng had been in love for four years. After Zeng Aiyun appeared, she decided to break up with Zhou. unable to give up the relationship, Zhou Yuheng was dissatisfied. He later learned from his classmates that Zeng Aiyun had "style problems". He told the story to Li Xia and advised her to come back to her. Zhou Yuheng is outstanding in his studies and is deeply loved by his tutors. He is also a "seedling" valued by the leaders of the college. After Zhou was killed, it was witnessed that his tutor was very sad and even "collapsed in tears". Zeng Aiyun decided to leave the emotional vortex. according to the file materials, at 19:30 on October 27, 2003, Zeng Aiyun, who was with Li Xia, called Zhou Yuheng to defend himself and asked him to meet in front of the library at 8 p.m., saying that he would return Li Xia to Zhou. At about 20:00, Zhou Yuheng, with the help of Chen Huazhang, came to the library as scheduled to meet Zeng Aiyun and Li Xia. After meeting, Zhou Yuheng didn't talk much with each other, so he was helped back to his dormitory by Chen Huazhang. at that time, Li Xia noticed that Zhou Yuheng looked dizzy and weak, and felt uneasy. She was ready to send him back with Chen, but Chen refused. After that, she still felt uneasy and contacted Zhou Yuheng and other students to greet her. at 23:40 on the same day, an overtime teacher found Zhou Yuheng's body on the grass and immediately called the police. there was a murder case on the campus of the University, and the local police did not dare to slack off. They promptly detected it and transferred it to the procuratorial organ for examination and prosecution. Xiangtan people's Procuratorate accused Zeng Aiyun and Chen Huazhang of intentional homicide in the indictment No. 17, 2004. According to the accusation, in October 2003, Zeng Aiyun was dissatisfied with the news that Zhou Yuheng told his girlfriend Li Xia about his past so-called "style problem" and advised them to break up, so he conspired with Chen Huazhang, who was jealous of his mentor's preference, to teach Zhou Yuheng a lesson. the prosecution alleges that at 18:30 on October 27, 2003, Chen Huazhang prescribed tranquilizer in Zhou Yuheng's tea. At about 22:28 on the same day, Zeng Aiyun left while Li Xia was answering the phone. He came to Room 308 alone and strangled Zhou Yuheng, who was sleepy in his chair, with a brown rope. After that, Zeng and Chen transferred the body together. Chen Huazhang cleaned the scene, took out Zhou Yuheng's mobile phone card, hid the mobile phone and the brown rope in his desk drawer, and wiped the blood on the ground with a rag. At 23:40 on the same day, Chen Huazhang used Zhou Yuheng's mobile phone card to send a text message to Zeng Aiyun and Li Xia with the same content, saying: "I quit. I wish you happiness." On September 1, 2004, Xiangtan intermediate people's court sentenced Zeng Aiyun to death and Chen Huazhang to life imprisonment for intentional homicide.

Flaws along the way

That night, lawyer Zhong Zhiyuan repeatedly looked through the copied files and marked them with a series of question marks. He noted that when Zeng Aiyun was first interrogated by the police, he insisted that he was "always with Li Xia" that night. After several interrogations, he changed his confession and admitted killing Zhou Yuheng. However, on July 14, 2004, when Xiangtan intermediate people's court held its first session to hear the case, Zeng Aiyun retracted his confession in court, saying that he had only made a guilty confession after being tortured. Since then, he has denied the murder in all previous trials. Zhong Zhiyuan told reporters that during the meeting, Zeng Aiyun told him that the reason why he admitted the murder was that he was tortured by the police. "He told me that during the interrogation, the police forced him to step on the horse for a long time, and he had to keep his upper body straight, otherwise he would be beaten. It didn't take long for the pain in his crotch and crotch to be unbearable. " When Zhong looked at the other evidence carefully, she felt that Li Xia, the key witness, had obviously made the testimony against Zeng Aiyun under the circumstances of being intimidated and illegally obtaining evidence: in the first two days of the case, Li Xia made five confessions in the office of Xiangtan University and the serious case brigade of Xiangtan Public Security Bureau, all of which said Zeng Aiyun had always been with her on the night of the case. Since then, she has been put into detention for the crime of covering up, and has confessed five times that Zeng Aiyun left her for about 20 minutes that night. And this 20 minutes is the time when the police determined that Zeng Aiyun went to kill Zhou Yuheng. Obviously, Li Xia is under pressure. Then, Zhong checked the evidence: in the file, police interrogators directly threatened Li Xia, "you are not a witness, but a suspect"; even stressed that "Ceng Aiyun must have left you at 10, you must answer..." Li Xia retorted angrily: "how do you know that you were not with him again?" As a result of the confrontation, Li Xia was charged with perjury and sentenced. the false evidence Li Xia was forced to give was not clarified until the fourth first instance of Xiangtan intermediate people's court in 2013, eight years later. Xiangtan intermediate people's court held that due to the induced questioning of the investigation organ, Li Xia's testimony against Zeng Aiyun was illegal evidence and should be excluded. All the way down, Zhong Zhiyuan is creepy. his investigation concluded that this was a thoroughly unjust case, and the police could not even withstand the scrutiny of the basic investigation logic. in his opinion, the evidence that the police found Zeng Aiyun's homicide - incomplete shoe prints of the same type as the sole pattern of Zeng Aiyun's shoes were left at the scene of the murder, Zeng Aiyun's fingerprints were found on the back of the chair, and a fiber of the same type as the brown rope in Zeng Aiyun's pants pocket - was questionable. Zhong Zhiyuan said that the identification conclusion of the Hunan Provincial Public Security Department is that the fiber in the pocket can only be identified as the "species" of the fiber on the palm rope, but not the fiber on the killing palm rope. "There is no inevitability between the two. We can't conclude that Zeng Aiyun bought and used the palm rope to kill people." Zhong told reporters. Secondly, the police said that there was a residual footprint at the scene, which was the same as Zeng Aiyun's sole pattern. "But it's only a 2 × 4cm mark. As for the fingerprints on the back of the chair, Zhao Youhong, the teacher of the room, proved that he never wiped the back of the chair when he cleaned the room, nor did he see anyone else wipe the back of the chair.
